General Terms and Conditions

§ 1 Scope

These General Terms and Conditions apply to all offers, contracts, and services in the field of photography between Stella Marie Ruhland (hereinafter "Photographer") and her clients.

Deviating conditions require written agreement.

§ 2 Contract Formation

A contract is formed through written confirmation (including email).

Offers are non-binding unless expressly stated otherwise.

§ 3 Copyright

1. The Photographer is the author of all created photographs within the meaning of copyright law.
2. Copyright remains unrestricted with the Photographer.
3. Editing, modification, or transfer of images to third parties is not permitted without express written consent.

§ 4 Usage Rights

1. Usage rights are granted only after full payment of the agreed fee.
2. Unless otherwise agreed, simple, non-transferable usage rights are granted.
3. Commercial use (e.g., advertising, campaigns, print products, resale) requires separate agreement.
4. When publishing, the following credit should be given where industry standard:

§ 5 Compensation and Payment Terms

1. The individually agreed fee applies.
2. Additional costs (e.g., studio, makeup, location, travel expenses, props) are billed separately.
3. Invoices are payable within 14 days without deduction.
4. In case of payment delay, statutory regulations according to § 288 BGB apply.

According to § 19 UStG, no VAT is charged (small business regulation).

§ 6 Cancellation and Rescheduling

1. Free cancellation or rescheduling is possible up to 14 calendar days before the agreed date.
2. For cancellation within 14 calendar days before the date, a cancellation fee of 50% of the agreed fee will be charged.
3. For cancellation within 48 hours before the date or no-show, the full agreed fee (100%) may be charged.
4. Third-party costs already incurred (e.g., studio, makeup, location, travel) must be fully reimbursed regardless of cancellation timing.
5. In case of verifiable illness or unforeseeable circumstances, a replacement date will be arranged if possible. There is no entitlement to this.
6. Cases of force majeure entitle both parties to reschedule. Third-party costs already incurred remain unaffected.

§ 7 Image Selection and Editing

1. Selection of finally edited images is made by the Photographer unless otherwise agreed.
2. Style and artistic design are at the Photographer's discretion.
3. Further retouching or modification requests may be charged separately.

§ 8 Liability

1. The Photographer is only liable for damages caused intentionally or through gross negligence.
2. No liability is assumed for technical failures, data loss despite standard security measures, or uncontrollable circumstances.
3. Claims for damages are limited to the amount of the agreed fee.

§ 9 Self-Promotion

The Photographer is entitled to use created photographs for portfolio purposes, website, social media, or exhibitions, unless there is an express written agreement to the contrary.

§ 10 Final Provisions

The law of the Federal Republic of Germany applies.

Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected.
